On February 19, 2010, counsel for the Plaintiff class, Deborah Greider, John Ammann, Barbara Gilchrist and Amy Sanders participated in a telephone conference with Judge Patricia Joyce, Assistant Attorney General Mark Long, Special Master Dr. Jim LePage, and Mark Gutchen, representative of and counsel to the Department of Social Services.  At that time, the Judge told Mr. Gutchen and Mr. Long that the Department had to have all the data that it wanted Dr. LePage to consider or which Dr. LePage had requested to Dr. LePage by the next day since Dr. LePage had been waiting for it for weeks if not months and since the accounting itself had been on-going for months.  The Department provided Dr. LePage with information the next day.

 

Judge Joyce ordered a hearing for March 22, at 3:30 in Jefferson City so that Dr. LePage could submit his final revised report.  Judge Joyce ruled that she would not reverse her previous decision regarding the statute of limitations and denied the Defendant's request.  Accordingly, the Special Master is to compute the damages going back to 1992.

 

Judge Joyce ordered the parties to prepare and submit memorandums of law on the issues of prejudgment interest, the use of projections versus actual damages on the issue of damage calculations in respect of back benefits, on the issue of attorneys' fees and reimbursement of costs advanced by MCB, and ordered the attorneys to prepare proposed findings of fact and conclusions of law and a judgment.  The issue of notice will be discussed and considered at that time.

 

The present thinking is that the Court is unlikely to continue this hearing unless Dr. LePage is unable to complete his work by this date.
