Regarding the class action law suit, we have been informed by
attorney Deborah Greider that Judge Patricia Joyce of the Circuit
Court of Cole County entered an Order on April 16, 2009, and has
found as a matter of that no statute of limitations applies to the
claims of the class members and that she ordered an accounting to
determine damages going back to 1992. Judge Joyce has ordered the
attorneys for the State of Missouri and the attorneys for the class
to convene a status conference on May 4 at 3:00 to discuss the
appointment of a special master for the purpose of the
accounting. Other matters, such as the mechanics of obtaining
records, lists of recipients going back to 1992, and other issues
pertinent to an accounting will likely be discussed as well. The
Court may have other issues to discuss at that time, and the Court
may have matters it wishes the attorneys to brief.
We believe that this is a significant step forward for the blind
citizens of Missouri, and we will keep you advised.
